Question 2: How do overseas production enterprises submit registration applications?

 

Answer: Unless otherwise agreed upon by the relevant overseas competent authorities and the General Administration of Customs regarding the application method and materials, the application for registration, change, continuation, and cancellation of imported food overseas production enterprises should be made through the registration management system of imported food overseas production enterprises (copy and open the website through the browser: https://cifer.singlewindow.cn ）Submit, or access the registration management system for imported food overseas production enterprises through the China International Trade "Single Window" portal website (copy and open the website through a browser: www.singlewindow. cn).

 

 

 

According to the degree of product risk, there are two types of registration application methods for overseas production enterprises:

 

 

 

1. Recommended registration by the competent authorities of the country (region) where the registration is located. The 18 categories of imported food overseas production enterprises listed in Article 7 of the Registration Regulations shall be recommended by the competent authorities of the country (region) where they are located, assigned their registration system accounts, and submitted applications through the registration system according to the process. The registration system account of the overseas competent authority shall be allocated by the General Administration of Customs.

 

 

 

2. Enterprise application for registration. Overseas food production enterprises other than the 18 categories listed in Article 7 of the Registration Regulations shall apply for their own registration system account and submit the application according to the registration system process.

Question 4: Do import declarations require the registration number of overseas production enterprises in China?

 

Answer: Yes. For food exported to China starting from January 1, 2022, when applying for import, the registration number of the enterprise in China should be specified in the "Registration of Overseas Production Enterprises of Imported Food" certificate column (license category code 519) under the "Product Qualification" section of the customs declaration.

 

In the implementation of the 2020 version of the declaration project, customs declaration of imported food should select "Overseas production enterprise of imported food" in the "Other enterprise category" column under the "Other enterprises" item, and fill in the "Number or enterprise name" column with the registration number of the enterprise in China.

 

If the declaration is not filled out according to the required standards, the customs will not accept the declaration.

 

 

 

Question 5:

 

Are the applicable requirements for packaging, labeling, and labeling in the "Management Measures" based on the date of import or production?

 

Answer:

 

According to the production date. Article 15 of the Registration Regulations states that "when registered enterprises export food to China, they shall mark the registration number in China or the registration number approved by the competent authorities of the country (region) where they are located on the inner and outer packaging of food exported to China", as well as Article 30 of the Management Measures regarding packaging, labeling, and labeling, which applies to food exported to China produced from January 1, 2022.

 

The packaging, labeling, and labeling requirements for food exported to China produced before January 1, 2022 are applicable to the original regulations.

 

 

 

Question 6:

 

How long is the registration validity period for overseas production enterprises of imported food?

 

Answer:

 

5 years. The registered overseas production enterprises of imported food shall continue to have valid registration qualifications. Registered enterprises shall continue their registration in accordance with the relevant requirements of Article 20 of the Registration Regulations during the period of 6 to 3 months prior to the expiration of the registration validity period.

 

Enterprises that fail to apply for renewal of registration in accordance with regulations will be deregistered by the General Administration of Customs.

 

 

 

Question 7:

 

Is there a registration fee for overseas production enterprises?

 

Answer:

 

The General Administration of Customs does not charge any fees for the registration of imported food overseas production enterprises.
