1. Natural Gem Raw Material Commodity Knowledge
1. The concept of natural gemstones
Natural gemstones refer to mineral single crystals or double crystals produced by nature, which are beautiful, durable, and rare, and can be processed into decorations. According to the "Notes on Import and Export Tariff Commodities and Items" (2022 edition), non industrial diamond raw materials should be classified under tax number 7102.3100, and gemstone raw materials other than diamonds should be classified under tax number 7103.1000.
There are a wide variety of natural gemstones, and there are over 60 specific gemstone varieties listed in the national standard GB/T 16552-2017 "Jewelry and Jade Names". The gemstone trading industry is often accustomed to dividing gemstones into high and medium to low grades according to the law of value. For example, currently recognized high-end gemstones in the international jewelry industry include diamonds, emeralds, rubies, sapphires, and emeralds (such as gemstones and cat's eyes), while mid to low grade gemstones include tourmalines, garnets, crystals, etc. However, in the national standards for jewelry and jade, there is no classification of high-end, medium to low grade, or common and rare gemstone types, and the use of these names to name gemstones is also prohibited.
2. Naming of natural gemstones
According to the national standard GB/T 16552-2017 "Jewelry and Jade Names", the naming of natural gemstones should follow the following rules:
(1) Directly use the basic names of natural gemstones and their mineral names, without the need to add the word "natural".
(2) The origin should not participate in naming, such as "South African diamonds" or "Myanmar sapphires".
(3) It is not advisable to use a combination of two or more natural gemstone names to name a particular gemstone, such as "ruby spinel" or "gemstone sapphire", except for "gemstone cat's eye".
(4) Names that are easily confused or ambiguous should not be used, such as "sapphire", "emerald", or "semi precious stone".
2. Normative declaration elements for natural gemstone raw materials
According to the "Import and Export Tariff Notes on Commodities and Items" (2022 edition), tariff number 7103.1000 includes gemstones (excluding diamonds) or semi gemstones, which are simply sawn (such as sawn into thin strips), split (along the natural plane of the gemstone layer), or roughly formed (i.e. only made into temporary shapes that clearly require further processing).
According to the "2022 Catalogue and Interpretation of Customs Import and Export Commodity Specification Declaration of the People's Republic of China", the specific requirements are as follows:
The standardized declaration elements for tax code 7103.1000 are: 1. product name; 2. Types (ruby, sapphire, emerald, jade, etc.); 3. Processing degree and status (unprocessed, simply sawn, rough formed, not strung, not embedded); 4. Source (natural); 5. Level; 6. Production area (soft jade and hard jade need to be declared as mines); 7. Scientific and English names of minerals; 8. Specifications (individual diameter, weight); 9. Chemical composition; 10. Number of pieces (jade number must be declared for Myanmar public trading); 11. Color.
3 Common examples of non-standard declaration
Due to the wide variety of gemstones, some have relatively similar commercial names, while others have similar mineral and chemical compositions, which can easily lead to confusion or omissions in the import declaration process.
